Group Health USA Explains November Exception to SHOP Participation Rules
From November 15 through December 15, eligible employers can apply without meeting SHOP's usual employee participation minimum.
DALLAS, TX, UNITED STATES, October 19, 2026 /EINPresswire.com/ -- Group Health USA is explaining an annual exception that lets eligible small businesses apply for health coverage without meeting the usual employee participation minimum. The exception applies to the Small Business Health Options Program, known as SHOP, from November 15 through December 15.
According to HealthCare.gov, employers applying during that period do not have to meet SHOP's minimum participation requirement. The exception returns each year. It is not a new rule, and it does not remove the program's other eligibility requirements.
Participation means how many of the employees offered coverage enroll or already have other qualifying health coverage. In most states, SHOP requires at least 70 percent to meet that test. State rules differ. Texas uses 75 percent. Employees who already have coverage through another source are not automatically counted as rejecting the employer's offer.
For an owner trying to arrange health benefits for a small team, that distinction matters. An employee covered through a spouse's job does not necessarily prevent the business from meeting its participation requirement. Employers should check which existing coverage counts before assuming too few employees are interested.
The November window addresses a different situation: an otherwise eligible business that still falls short of its participation minimum. During the annual exception, that minimum is not a barrier to applying for SHOP coverage.
Other conditions remain. SHOP generally serves employers with 1 to 50 full time equivalent employees, with some states allowing up to 100. A business must have at least one full time equivalent employee other than owners, spouses and family members of owners, and partners. It must offer coverage to all full time employees and have an office or employee work site in the state whose SHOP it uses.
Group Health USA encourages employers reviewing this option to separate three questions: whether the business qualifies, whether suitable SHOP plans are available locally, and what the coverage would cost the business and its employees. Employers should confirm application requirements and the proposed coverage start date before making changes to an existing plan.
The participation exception does not guarantee a lower premium or automatic enrollment. HealthCare.gov provides the eligibility rules, state participation information and a calculator for checking the required employee participation rate.
